Abstract

This article reviews selected recent appellate court decisions involving labor arbitration. Several of the cases reemphasize the importance of the submission statement and the need to relate the decision to the statement. Some courts have shown an increased willingness to review arbitrators' decisions reducing disciplinary penalties. Courts are also continuing to wrestle with the relationship between legal action for wrongful discharge cases and federal labor law. Finally, the Supreme Court has reaffirmed its position favoring arbitration of labor disputes.
