Abstract

The right of a board of education or a college board of trustees to deny reemployment, or tenure to a teacher or professor for "any reason or no reason" is no longer absolute; the denial may not be in retaliation for the teacher's exercise of his constitutional rights, which include union membership and activity. This article examines several cases in which this principle was tested and describes results, pending Supreme Court review, and implications.
