Abstract

Most state public employee bargaining statutes mandate negotiations over "conditions of employment" while excluding from negotiations matters of "educational policy." In certain areas, such as teacher tenure in public education, this inclusion and exclusion overlap. The author reviews state laws and court decisions that have provided some rulings and precedents on whether tenure is a negotiable item.
