LAWYER UNIONIZATION IN THE QUASI-GOVERNMENTAL, PUBLIC AND PRIVATE SECTORS

Abstract

Lawyer unionization is a new development in labor law and collective bargaining. The notion of lawyers combining together into units to bargain collectively about the terms, wages, and conditions of employment has traditionally been anathema to the legal profession. But this resistance has been crumbling of late in three areas which this article will examine: lawyers in the quasigovernmental, public, and private sectors. The lawyers' embrace of unions has been primarily for economic and social reasons, valid justifications for any group's organizing. However, private sector attorneys are still among the most ardent holdouts in resisting unionizing efforts and the outlook for unionization there is bleak.
