Abstract
This article reviews appeals to the commissioner of education of panel decisions under Section 3020-a of the New York Education Law concerning the dismissal of tenured teachers. The analysis shows that panels and the commissioner apply different principles of penalty in rendering their decisions. The commissioner is found to be a tougher judge of teachers, overturning panel decisions in which mitigating factors such as years of service lessen the punishment meted out by panels.This work is licensed under a Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 United States License.
