Abstract

This article discusses the role of an arbitrator in interpreting contract language when faced with grievances based on the parties' differing understandings of the negotiated language. The author describes the fine line an arbitrator must tread in making a grievance award between adhering to the intentions of the parties to the contract and redefining their intentions. Rights arbitration, interest arbitration, and a "living document" contract are discussed.
