Abstract

This note provides a survey of the Duty of Fair Representation in the public employment sector. Its origin, nature, and scope are compared and contrasted with its private sector counterpart. The Author concludes that the scope of the Duty in the two employment sectors is virtually identical and suggests that this may not be constitutionally compatible.
