Abstract
This article explores the effects of expanding employment rights to include drug testing. The article reviews some of the issues covering drug use and drug testing in the workplace and how they relate to employment rights. The effect of drug testing as an employment right is examined using economic theory. The economic approach argues that drug use as a solution to the adverse selection problem creates other problems such as negative externalities. The article concludes that adverse selection and negative externalities may not be solved by making drug testing an employment right. This work is licensed under a Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 United States License.
